MnM License Agreement

This license applies to MnM Version 2.0 and later (hereinafter referred to as “MnM”).

Portions of MnM (henceforth referred to as "the Software") were developed by the Knowledge Media Institute at The Open University, UK (OU/KMi). This agreement does not transfer any rights or remove any obligations on the user in respect of any other software or other components used in MnM. Such software or components including proprietory legends or notices must be used complete and unmodified only as part of and for the sole purposes of running MnM.

Access and use of the Software imposes the following obligations and understandings on the user:

The Software is provided free of charge and is made available for non-commercial use only. The user is granted the right, without any fee or cost, to use, copy, modify, alter, enhance and distribute the Software, and any derivative works thereof, and its supporting documentation for non-commercial purposes, provided that this entire notice appears in all copies of the software, derivative works and supporting documentation.

You may not use the Software for commercial purposes, which includes, but is not limited to, integrating all or part of the Software into a product for sale or license to a third party or use of the Software or any derivative of it for research with the final aim of developing products for sale or license to a third party. You may not rent, sublicense, sell, assign or transfer the Software or any part of it.

Further, OU/KMi requests that the user credit OU/KMi in any publications that result from the use of this software or in any product that includes the Software.

The Software could include technical or other mistakes, inaccuracies or typographical errors. The Open University assumes no responsibility for errors or omissions in the Software. Changes to the Software may be made by the Open University from time to time, without notice.

The Software is provided 'as is' without warranty of any kind, either express or implied, including but not limited to any implied warranties of quality, fitness for a particular purpose or ability to achieve a particular result. No advice or information, whether oral or written, obtained by you from the Open University or from the KMi web site shall create any warranty for the Software. The user also understands that OU/KMi is not obligated to provide the user with any support, consulting, training or assistance of any kind with regard to the use, operation and performance of this software nor to provide the user with any updates, revisions, new versions or "bug fixes."

In no event shall the Open University be liable to you or any third parties for any damages which arise directly or indirectly from the use of the Software, including but not limited to special, punitive, incidental, indirect or consequential damages of any kind, or any damages resulting from any lost profits, lost savings or loss of data, whether or not the Open University has been advised of the possibility of such damages arising out of or in connection with the use of the Software.

The Open University retains all Intellectual Property Rights in the Software.

KMi and the KMi logo are trademarks of the Open University, Walton Hall, Milton Keynes, MK7 6AA, UK. The names OU, The Open University, KMi and/or Knowledge Media Institute, may not be used in any advertising or publicity to endorse or promote any products or commercial entity unless specific written permission is obtained from OU/KMi.
